Terms of Service
Facility Recon, Inc. · last updated October 23, 2026
These terms are the agreement between you and Facility Recon, Inc., a Wyoming corporation doing business as EHS Recon ("we", "us"), for the use of ehsrecon.com, app.ehsrecon.com and everything we deliver through them (the "service"). By creating an account, placing an order or using the service, you agree to them. If you use the service for a company, you agree for that company and confirm you may.
1. What the service is
EHS Recon reads public government databases about regulated facilities — federal ones such as EPA's and OSHA's, and the state databases named on our Data Sources & Methodology page — keeps the history of what they say, and reports it: one-time reports on a facility or an area, and monitoring that tells you when a facility's records change. Every record we report names the government database it came from and that database's own record id, so you can check it at the source.
2. Public records, not advice
We are an independent information service. We are not a law firm, an environmental consultant or a compliance adviser, and nothing we deliver is legal, compliance, engineering or investment advice. We are not affiliated with, endorsed by or acting for EPA, OSHA, any state agency or any other government body.
The records come from the government's own files, and those files can be wrong, incomplete, late, restated or withdrawn; agencies also publish many records weeks or months after the events they describe. We report what the files said and when they said it, and we may also be wrong in how we read, match or classify a record. Before you rely on a record for a decision, check it against the government source we link. If something looks wrong, email contact@ehsrecon.com with the facility and the record: a person reads every report, and where our matching or classification was at fault, we correct it. We do not change the government's records; a correction to those is made with the agency.
3. Your account
You sign in with an emailed link or with a Google or Microsoft account. Keep access to that email and those accounts secure: anyone who can sign in as you can use your account, and you are responsible for what is done with it, including by the people you add to it. Give us accurate account and billing details and keep them current. You must be at least 18 years old to create an account.
4. Orders, prices and payment
A report's price comes from the public record of the facility or area it covers and is shown before you pay; the current prices are on the Pricing page. Prices are in US dollars and do not include taxes; if we are required to collect a tax, it is shown at checkout before you pay. Payment is taken by our payment processor, Stripe; card details are entered into Stripe's form and never reach us. An order is accepted when the payment succeeds; each report in it is produced after that and placed in your account, where it stays available to download while your account is open.
5. Monitoring
Monitoring is a monthly subscription, one per account, covering every facility the account monitors. The first month is charged when you buy it, and it renews monthly from that day until you cancel. A facility added during a month is charged for the days left until the renewal, and the subscription's price for all your facilities is updated from the next renewal; we change a subscription's price only at a renewal.
Monitoring means we check the covered government databases each night and tell you when a monitored facility's records change: in your account, by email as your alert settings choose, and in a monthly report. We cannot promise that an agency publishes on time, that its server answers on a given night, or that every change is caught the night it is published; when a database was not updated on a night, we say so. A Facility Historical Report includes 90 days of monitoring for its facility; that is not a subscription and ends after 90 days unless you buy monitoring.
6. Refunds and cancellation
Cancelling monitoring. You can cancel any time from Billing in your account. Monitoring continues to the end of the month already paid for, nothing more is charged, and you can resume it until then.
No refunds. A report that has been delivered, and monitoring time that has been paid for, are not refunded, including when monitoring is cancelled or an account is deleted part-way through a month.
A report we could not produce. If a report you paid for fails to produce, we produce it; if we cannot, we refund that report's price. If you think a charge is wrong, email contact@ehsrecon.com before disputing it with your bank, and we will answer within one business day.
7. Using what we deliver
You may use our reports, alerts and pages for your own business and share them with the people you work with on a matter: your clients, lenders, insurers, buyers, sellers, auditors and advisers. Consultants may deliver reports to their own clients, including under their own letterhead where the service offers it.
You may not resell or republish our data in bulk, use the service to build or feed a competing database or service, copy the service by automated means (scraping, crawling or bulk calls to our interface beyond ordinary use), get around a limit or a security measure, interfere with the service or other users, or use it for anything unlawful. The government's records themselves are public; our compilation, matching, classifications, report designs, software and brand are ours, and these terms do not transfer them to you.
8. Deleting your account
You can delete your account from the Account page, and you can download everything in it first — every report, every alert and your orders. Deleting it ends monitoring at once and deletes your reports, alerts, monitored facilities, folders, settings, letterhead and the access of anyone you added. We keep the customer record — your name, email, billing details, our payment processor's customer reference, your orders and the record of your payments — for receipts, taxes, accounting and disputes. Deleted data leaves our database backups as those backups expire. We may suspend or close an account that breaks these terms; we will tell you why unless the law or a security reason prevents it.
9. Warranties and liability
The service and everything delivered through it are provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement, and we do not promise that the service will be uninterrupted or error-free.
To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or business opportunities, arising from the service or these terms, even if we were told they were possible. Our total liability for all claims arising from the service or these terms is limited to the amount you paid us in the twelve months before the event that gave rise to the claim.
You agree to defend and hold us harmless from claims by others that arise from your breach of these terms or your unlawful use of the service.
10. Changes
We may change the service and these terms. When we change the terms in a way that matters to you, we will post the new terms here with a new date and, for an account holder, email you before they take effect. A price change to monitoring applies only from a renewal. Continuing to use the service after a change takes effect means you accept it.
11. Law and disputes
These terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-law rules. Any dispute arising from them or the service will be heard only in the state or federal courts located in Wyoming, and both of us agree to those courts' jurisdiction. If a court finds part of these terms unenforceable, the rest stays in effect. These terms, with the Privacy Policy, are the whole agreement between us about the service.
